Default My landlord is going through foreclosure

but, he still has not brought a lease to us to sign.?

If your lease has expired and you are there on a verbal contract, should he have to give the house back, you are out of your lease.
If you have time on your lease left when it does go to foreclosure, that would be worked out with the new owner.
Either way, if you want to get out of it when the bank takes it, you will be able too.

Why do you need a lease at this time? Is it to protect your rights for that apartment?

Speak to the landlord. Go to a commercial stationary store and get a blank lease form. Fill it out and ask him to sign. With foreclosure pending he may be to distraught to do anything. Help him out and you help yourself out as well.
