Default Foreclosure Confusion - Help?

I do not understand this note thing. My deed of trust states: borrower understands and agrees that MERS holds only legal title to the inerests granted by borroer in this security instrument, MERS has the right to foreclose. But Deutsche Bank is trying to foreclose on me. Is this accurate? I have been very lucky to this point as we have had 2 hearings scheduled and their attorney has continued them both due to lack of proper paperwork. I'm thinking I will not be so lucky next hearing date. Could you please let me know if Deutsche Bank can legally foreclose on my home or if it must be MERS.
