...foreclosure, my aunt is in the house, but I am 1 of 2 heirs. What do I do? My dad's recently deceased. The bank is foreclosing his house, but my aunt is living in it! I'm one of two heirs and I'm curious on what I can do... More info.: I was adopted by my father, which his family refuses to recognise. My half sibling is under 18, but his mother wants to be bought off if I were to pay the bank the amount owed to the bank in full. She says that it is usually what happens when there is more than one heir in the situation. I was told I could send a letter to my aunt and ask her to move out within 5 days, and if she doesn't, that I would have to go to court to get her forcfully removed (I don't know the proper term) from the house. I don't know the details on payments or how much is owed to the bank, but I do know that I need a place to live. Is it really mandatory to pay off the other heir if I want the deed in my name (since I would pay off the bank on my own) and no problems with his mother in the future? And is it possible for her (if I pay it all off) to charge me rent, or to sell the property, or take me to court saying that her & her son have the right to move in or rent it out if I don't buy off her son's "interest" in the house (b/c he is also an heir)?
