Default Help with Foreclosure?

We called our mortgage company serveral times to get help with a payment plan or loan motification, but they said they couldn't help us. We then fell behind on our mortgage by 3 months. We were sending in partial payements. We called our mortgage company to find out why they didnt take our payment this month and they said they could not accept a partial payment because we were in forclosure and there was nothing she could do. We had to pay to get current ($3900) Two days later we called to pay the balance...(loan from parents). We were told they would not accept our payment unless we payed $2000 in lawyer fees. We NEVER recieved any mail telling us of the foreclosure or a letter from the lawyers until AFTER we found all this out. Now all of a sudden we owe $7400 by the end of the 30 days for court costs, inspections, appraisals, ect. NO ONE will help us. (not even the Veterans Affairs) We have the money to become current. Should we contact a lawyer? Why are the fees so high, after only being notified BY PHONE a week ago??We have Mortgage Corp Investors(MIC) for GMAC, VA Guaranteed Loan)-I know it's my fault I'm in this situation...we had financial difficulties, once we were late, we just couldnt catch up on the previous payments and we really just want to stay in our home. Just need advice. Thanks.

The states have different requirements for proceeding with foreclosures. Some legislatures have adopted stringent notice requirements with built-in waiting periods before a lawsuit to foreclose on a mortgage can be filed. Without knowing where you live and what sort of communications you've been receiving, neither I nor anyone else can tell you whether those requirements have been met. If you do live in a judicial foreclosure state, however, it doesn't sound as though you received valid notice at all.Consult with an attorney in your area ASAP.
