Default foreclosure squaters? help?

Ok I am in desperate need of some advice...my brother passed away in October of last year. He purchased a townhouse and had some small equity built up in it. My Mom made the mortgage payments for months and only missed 4 or 5 payments. She missed the payments because the bank told her due to the small amount of equity in the home she should just let it go into foreclosure. The taxes went unpaid because she completly forgot about those. I was living in Florida and she had asked me to come back - live in my brothers old house (since no one was there and it is just sitting here anyway) and help her to get caught up on everything. ie it would be like I am taking over the house. She called the bank once my family moved in asking how much is owed and when it is due by. They told her the house is already in preforclosure (even though she never received any letters) they told her even if we were to pay up to date the mortgage and the taxes there is no guaranty that we can still keep the house. They recommended we wait until the house goes up for auction.What are my options here...what can we do? In my brothers will he left the house to her and also made her executer of his estate....Are we now considered squaters?
