Default What are my rights as a tenant whose landlord has...

...had to go into foreclosure? We are in a six month lease that is up in Spet. Our landlords informed us today they have or will be going into foreclosure. They say that we can continue to live here until the foreclosure goes thru or the bank "evicts" us. They say it can take an indefinable amount of time. How long can we live here? Is our lease no good? Will this "eviction" count as a real eviction, even tho it is thru no fault of our own? We live in California.

Google -Tenant Protection Act of 2009..You should be Ok -but will be in an even better position if you want to stay longer if the LL extends that Lease for you. Since this is Federal Law it overrides any State specific Laws.

The Tenant Act is about affordable housing. They receive subsidies from the states and the feds. Your landlord has given you the required amount of notice. So you will probably be ok til your lease runs out. After that though you risk being a squatter. Also it is not through any fault of yours. The same is true of the Bank. Also this is not an eviction at all if you are allowed to stay to the lease's end. There is no law that says a landlord/owner has to renew a lease.
