Default Should I let my house go to foreclosure?

I own a house that was valued at $240,000 but now the value is $180,000. I am living paycheck to paycheck and am sick of it. I am thinking of going into foreclosure with the guidance of my lawyer. My lawyer says that I can live in my current home for one year before the bank takes it. In that year I would save all my money for a down payment on a different home. My current home only has 2 bedrooms and is slowly in need of repairs. If I repaired the house it would be too expensive and still the house wouldn't get any bigger. The area I am looking at has newer 4 bedroom homes in the 250's. Would this be a good idea? What are the risks? Benefits?
