Default Property Lessee's Rights on Foreclosure?

My Landlord is in foreclosure- Its apparent he is not going to do anything about it. He actually denies being in foreclosure.I have heard from an attorney helpline that I will be moving but probably not before the auction sale date. However, My questions areo I have to continue paying rent to my landlord if he is in foreclosure? Is it legal for him to continual receive rent if he is not paying his bills? If I do pay rent do I pay it to him or the bank who the loan is with? Do I still need to give him notice I am moving? If so is it the standard 30 days? Can anyone help me with answers to the above questions?I have been told that A. It is illegal for him to collect money if he is not paying his bills? Is this true?I have been told that I would not be evicted until the date of the sale of the property, it could be 48 hours or thirty days?I have gotten many conflicting bits of information, just enough to panic.FYI My landlord has been in foreclosure since Jan 21st According to the paperwork and Assessor's office. Property is located in Jefferson County, COThank you to anyone who can help!

Do I have to continue paying rent to my landlord if he is in foreclosure? Is it legal for him to continual receive rent if he is not paying his bills?Yes. A house has either been foreclosed on or it hasn't. Until it has been foreclosed on the owner is entitled to be paid rent. Your rental agreement has nothing to do with his bills and your requirement to pay rent isn't contingent on him following through with his debtors. There is nothing you have or could have done to be entitled to live there for free. If I do pay rent do I pay it to him or the bank who the loan is with? Again, it depends on what side of foreclosure the house is on. If the bank owns it, the bank gets the rent. Until you've heard that's the case, you continue to pay your current landlord. You will hear from the bank, either be it for rent or a cash for keys offer.Do I still need to give him notice I am moving? If so is it the standard 30 days?Yes. Again, without the actual foreclosure taking place he has not lost the house in any way, shape, or form. You are bound to the rental agreement as well as state law which states the thirty day notice requirement. You heard wrong. His bills have nothing to do with you. Until the foreclosure takes place, he's in the position to save himself (doesn't matter if it's apparent he won't) New foreclosure laws require the bank to either honor the lease or give a 90 day notice to vacate in the event of a month to month tenancy.Short answer- Find out if the house has actually been foreclosed on.
