Default Just found out apt bldg is in foreclosure.?

Landlord said its not in foreclosure but I have papers showing it is in preforclosure and I feel before I pay rent she should show us proof of what she is saying is true. Obviously my rent isn't paying what needs to be pd. I am keeping the rent in my account and when it is taken out of foreclosure like she says it will be then I will pay her all that is owed to her. Does anyone know how this works? Do you continue to pay rent or save it in case you have to move due to the foreclosure? My father in law just went through this and got screwed by continuing to pay his rent.

You can and should be evicted for what you are doing. The property owners financial mess, is just that, theirs. It's none of your business.

You have just cause as I'm sure any lawyer in your locale will tell you.If the landlord doesn't want to prove it to you, then you can file a lawsuit against the landlord for a contemplated breach of contract as evidenced by an actual or constructive notice of "operation of law" called a pending foreclosure action notice. The landlord will have to prove something in court! You will still have to pay rent, only now, you will pay the rent into the court treasury, until the court decides the case. Get a good lawyer, because there are lots of rules in the landlord's security instrument about not paying mortgage on the building including rent has to be paid to lender instead of landlord. Get a smart lawyer because you might even have more rights!###
