Bank is bypassing foreclosure, calling for our
personal guarantees.? We built and own a condo unit that is in civil litigation as an investor believe the unit belongs to him. There is a lien on the unit by the bank, but they cannot foreclose on it because the investor put a Notice of Claim on the title so it cannot be transferred. We want the bank to get the unit so we can be done with this frivolous lawsuit. Since this appears to be a long process, the bank wants out and is now calling in our personal guarantees. Can a bank bypass the foreclosure process and do this?
