chapter 7 be an option? c in my situation my home will not sell because of what i owe and the balance on the home. you would think with this economic situation banks would do all they could to keep you in the home. now igf i wanted to give it up then i would be ok with that but i want stability for my children.

If you owe money on the house (it's mortgaged), then Chapter 7 bankruptcy in and of itself cannot be used to keep the house. HOWEVER; if you file Chapter 7 on a bunch of OTHER unsecured debts that are tying up all the money you should be using to pay your mortgage, then yes, it may be an option. All the money saved by filing Chapter 7 could help you keep up with your monthly mortgage. However, the newer bankruptcy laws actually make it quite a bit harder to actually file for Chapter 7. Check with a bankruptcy lawyer, they will have the best ideas for you, in your state. Good luck.

is there a really good reason you are behind, or are you just not paying. if there is a reason, you may want to talk to mortgage co. and ask if they will do a short sale, which means they will take less than you owe,if it can be sold? but ask if you will be responsible for rest.

first off buddie, you need to learn how to post something that makes sences. anyway, along time ago, around 1990, we went through the same thing. Lots of lay offs, ect. All the banks said "oh if your laid off we understand and will work with you". My bank, one of the ones advertising this line of BS, told me, when I was laid off. "Pay on time or we'll foreclose" True.So, I found a bunch of bullshit paying nothing jobs and busted my ass day and night and weekends so i would not loose my home. Once back on my feet, my wife filed for divorce because I was working some much and i lost the house to her anyway. LOL, LMAO!!! TRUE!!
