My sister has lost her job, and is having the worst luck. Well, her property is getting foreclosed on, will she have to appear in court or is that just certain circumstances (such as deed in lieu or short sale)? Someone told her that the Mortgage company can take her to court for an unlawful detainer. Is this true?

It all depends. If she has no Job, the mortgage company probably want sue her since she cannot pay , and they cannot garnish her wadges. I would try to do a short sale, she can help someone get a low mortgage, and salvage her credit. She could aslo file for ch. 7 or 11 bankruptcy, she would get to keep her home, but she would have to start making up payments in 3 years.
