It was an 80/20 loan and they tacked on about 30,000 to the second mortgage and cut the payment period to 15 years. The interest was reduced to around 5.4%. We fell two payments behind again and they are threatening to stop accepting our payments unless we get caught up. It’s an upside down loan. We have another mortgage through HFC for about 20,000. We want to pay that off in time, if possible. We were working through Wells Fargo intermediary called American Servicing Company (ASC) but it is a nightmare. They told us we were qualified under Obama mortgage relief plan and to expect the paperwork any day. When we didn’t receive the paperwork we called and didn’t qualify, etc. We must have faxed in all the paper work 12 times and were told different stories every time.* We want to get from under this mess unless we can cut the overall payment in half. Linda’s ex-husband started a lawsuit over his fabricated concerns over 2 ½ years ago. After his concerns were proven unfounded, he continued to try to fabricate issues that created a serious financial strain on us. Linda’s ex-husband has access to resources that we don’t. We had to maintain a lawyer during this 2½ year period to protect the children from her ex-husband. The lawsuit was resolved in May of this year in our favor. It created a very serious hardship because we had to choose between paying the mortgage or protecting the children. It was a balancing act of sorts. Again, this situation is resolved. County: Orange My husband’s salary went down due to furloughs last year and into this year. They will continue at least until the end of May. I did work and contribute significantly toward our income until May of 2008. I recently was able to procure a very part time work-at-home position to help pay our mortgages. Currently we have a small cash reserve in case we are unable to pay our mortgages and HOA payments for 2 months. Our lender for our 1st mortgage, EMC, said they could not give us a loan modification at this time because we have kept this emergency cash reserve. Our 2nd through Wells Fargo Bank, N.A. was reportedly unable to be modified because we needed to \”make more or have less debt\” to be able to pay a reduced amount. They claimed we did not make enough to be able to pay a lower amount, and therefore we have to continue to pay the HIGHER amount (which makes no sense). We feel that if we receive help, perhaps we will be able to modify our existing loans so that we are not forced to use all of our emergency reserves and eventually lose our home. To date, with assistance from family, we have not yet missed any mortgage payments, but they cannot (as of June 2010) continue to assist us. As noted above, our income went down about 30% when I stopped working in May of 2008 to raise our two young children. Our first mortgage is through EMC and our second is through Wells Fargo Bank. As also noted above, furloughs and lack of significant raises or promotions within my husband’s job has also negatively affected our income.
