Default Denied for a Loan Modification with Bank of America

To all concerned, I am writing to you in an effort to receive help in dealing with The Bank of America. I am a resident of the state and county of Hawaii and have been for the past 9 years. My business is in restaurants in Kamuela and at the Mauna Lani Hotel and I employee over 60 people as well as support many local business’ and farmers. My problem lies with the home mortgage loan modification program, which I have applied for due to unforeseen economic changes here and abroad. I purchased my home while still operating a viable restaurant in Tokyo which I had for 13 years, the income from which was sufficient to pay the mortgage on my home. My company then chose to open a restaurant in Kona and did very well for the first 4 years of operation. At the end of the lease the landlord decided to raise the rent to such a degree that we chose to close the restaurant and focus on a second restaurant we had opened in Kamuela. Around this time the Japanese economy began to falter and we were forced to close the restaurant. This put extreme pressure on our abilities to pay our mortgage. Approximately 8 months ago I applied to Bank of America for assistance and was told to file paperwork, which I did. next I was told the process would take 90-120 days to complete and to check with the bank after 90 days. My call to the assistance department was greeted with a \” your file is still under review\” and to call back. This was a continual pattern until the 5th of November when I received a call from them stating that indeed I qualified and my rate as well as my monthly payment would be reduced. After waiting for over a month for the paperwork to arrive, I received a mortgage coupon booklet that listed my payments $1000 higher than it had previously been. When I called to inquire why, I was told that my file was still under review and to call back. I spoke to a supervisor and was told due to a bank merger they could not see the offer I had received, but to call back after a week. During this time I was not making payments as I was advised to wait to see what the outcome of my case would be. I was also receiving calls asking if I was going to make a payment. During one such call I, as usual explained the situation to the operator and she in fact did see that the offer had been made and would contact the appropriate department to find out why, I never received the paperwork. I did not receive the paperwork and now after repeated calls the previously mentioned information is no longer available.
I am writing to you in hopes that someone can intervene on not only my behave but the hundreds of other people that are having the same problem with this bank. The mediators I have spoken with as well as the many people who have shared their stories on line should be proof enough of the unlawful as well as the poor manner in which this lender is doing business. Please do what you are able, to force Bank of America to conduct business in a forth right manner. I appreciate your time and consideration. We had our own moving company. Work got slow in November, got behind on payments and couldn’t catch up. We had to close the company a year later. We had the business for 5 years. We were always on time with our payments. My husband has moved to New York for a job so we can get back on our feet. My mortgage company is Bank of America. I have been trying to work with the lender as there was a loss of income and keep getting told there is nothing I can do the income has started to return somewhat but they still will not work with me to help in getting caught up This is with Bank of America* Do you have any ideas this is a fifteen year mortgage and have tried to change to 30 even but won’t do because of behind payments.
