3 men indicted in Utah flipping and straw borrower scheme

Tolman, United States Attorney for the District of Utah announced that the following defendants have been indicted for Mail and Wire Fraud, Money Laundering and Conspiracy.- Ronald W. Haycock, Sr. age 61 of Bountiful, UT
- Lyle Smith, age 43 of Roy, UT
- Jamis Melwood Johnson, age 57 of Salt Lake City, UT
The case is being handled by the Davis County Attorney’s Office, Utah Insurance Fraud Division, HUD Office of Inspector General, FBI, the U.S. Attorney’s Office and Members of Utah Mortgage Fraud Task Force, which includes representatives of several local, state, and federal law enforcement, prosecution, and regulatory agencies.

A summons will be issued to each defendant to appear for an arraignment in federal court. The arraignment date has not been set.Defendants charged in indictments are presumed innocent unless or until proven guilty in court.
The alleged fraud scheme is outlined in paragraphs 1-19 of the indictment.
There are 10 counts of mail fraud; 12 counts of wire fraud; one conspiracy count; and 15 counts of money laundering in the indictment. Notice of intent to seek forfeiture of $2,865,000.
The indictment shows that the defendants are alleged to have acted as follows:- Haycock formed 4 companies which are associated with the scheme:
Lawrence Skinner and Associates and its subsidiary Paramount Strategies which conducted real estate transactions and investments; Layton Davis Financial which managed properties on behalf of Paramount and Ireland West, LLC which conducted real estate transactions and managed the proceeds from those transactions.
- Smith helped manage Lawrence Skinner and Layton Davis and identified properties to be purchased by them.
- Johnson helped in the activities of Lawrence Skinner, Layton Davis and Paramount and prepared VOA’s and VOD’s to help facilitate loan closings.
- Various straw borrowers were recruited by them to facilitate the purchases and at times the applications submitted by them contained false and misleading information.
- The straw borrowers were promised that there would be no risk to them, that they would not have to make downpayments and that mortgage payments would be made for them by one of the above companies. In addition they were paid a fee from closing of the loans via an LLC they were asked to create to receive the payments.
- False appraisals were submitted to inflate the value of the properties above the agreed sales price to enable the defendants to remove funds from the transactions.
- The lenders who were victims of the scheme are America’s Wholesale Lender, Countrywide, Argent, Paragon Home Lending, Shoreline Lending and Mountain States Mortgage.
