Can a towing company sell your car without the
title & without transferring the title to the new owners name? My husbands car was towed nearly two years ago from his apartment complex parking lot for sitting in the lot for too long. We assumed the car has been towed but were not notified by the towing company that they had our car. A few months later we were contacted by a collections agency who was collecting the debt on behalf of the towing company. We paid them the money we owed and it finally came off of our credit report.This week we received a letter from the North Texas Tollway Association saying we owe $236.26 in toll fees for this car that was towed. We have not had possession of the car for nearly two years. After many hours and several phone calls later we discovered that the towing company (Southwest Auto Tow) has sold our vehicle and did not transfer the title into the new owners name. We have no idea who the car was sold to and therefore can not request a Vehicle Title Transfer. The car is legally in my husbands name and we are responsible for any tolls, tickets or accidents that this car gets in. Because the car is still in our name, should we report it stolen to get it off the street? We don't know what to do! Is this legal? Has anyone else had to deal with this? What do we do? I appreciate any help or advice that you can offer.The towing company refuses to provide us with any information. They will not give us any paperwork that shows the car was towed. I'm not sure where else I could get paperwork to prove that we no longer own the car. Ant the tollway association will not take the car out of our name because we can not prove the towing company sold it.
