...how long before foreclosure begins? a friend fell behind on his mortgage< How long before the bank files suit does he have to correct the default?the thing is this. He has already cured he default and had done so prior to the bank filing the forclosure. All paper work proves he had paid any and all arrears priorto the filing of the suit. Now the bank wants him to pay the attorney fee and late charges they now claim he owes. on a fee of $30. with late chages accumulating each month since 11/08. PS the note was paid up to date by the 11/08 date. and has not been late nor behind since. So the bank admits he had paid prior to them making the filing, yet still insist he Must pay the $30 fee + $26 a month late fee on that same $30 for a period of 8 months. The $30 was paid by him a well as soon as they notified him he owed it. Bare in mind he has a total of 8 open loans on property with this bank, with none being behind. The one only fell behind because it was part od a divorce where spouse refused to sell or sign off on property. So what would you do and how would you handle this. The bank has ruined his credit
