...mortgage? Mortgage company put us into foreclosure on the 1st because of being behind in the escrow but there is a second on the house, with the same company. How does that work?

It depends. for starters it is expensive to start foreclosure proceedings so a lender will not foreclose on both loans if they own both. If there is a workout they also do not want to have homeowners pay twice for attorney fees. I have had both when working with lenders, sometimes will modify both loans and others they fix (modify) the first enough they can put second on a repayment plan. That's rotten eggs ... you're saying you're in foreclosure for not paying your escrow (taxes and insurance)?Have you talked to the company to find out if they are willing to restructure everything?
