Once Notice of Default has been filed with the county, the borrower generally has 3 months and 21 days minimum before the home can be foreclosed upon. The timeframe varies from state to state. For California, new legislation passed forcing teh banks to call homeowners 30 days before NOD can be filed to work out a loan modification, short sale or other solutions.
