Default Does anyone have any idea as to how many

months a mortgage can be in default before is goes into foreclosure?

According the mortgage papers the loan is in default if it's not paid by the due date, but after 30 days the banks sends default notices.

one, but it is such a nuisance and expensive that it is normally much longer than that and the mortgage holder tries to negociate

A note is technically considered to be in default as soon as the payment due date has surpassed with no payment. Once Notice of Default has been filed with the county, the borrower generally has 3 months and 21 days minimum before the home can be foreclosed upon. The timeframe varies from state to state. For California, new legislation passed forcing teh banks to call homeowners 30 days before NOD can be filed to work out a loan modification, short sale or other solutions.
