Should I go into foreclosure if I am
$120,000 in negative equity and failed in a loan modification attemp? I have been making payments (barely), burned through $30,000 of savings in the last two years

Are you able to make your mortgage payments? If so, hang on to your property. Consider renting it out. Don't foreclose until it's a last resort as it will have a long damaging impact on your credit, making it difficult to even rent an apartment. Being in negative equity is not a reason to foreclose.
