home has been foreclose can mortgage company take...

...income tax refund? Our home has been foreclose,but we have not been to court no date has been set as of 1/18/2011. and we have not heard anything at all from mortgage company all we got was a letter from lawyer we have 20 days to respond but that was it,my question is can this company take our income tax refund if we have one due?
