...joint mortgage with me in our house. We are separating? It is not amicable so who makes the call on sale or rent and the apportionment of rental income if there's a dispute?

that's why you should have gotten married. divorce court would have settled thisyou need to go to civil courtthe judges will probably say the same old lame shtick: One of you needs to buy the other one out and re-fithat rarely ever happens. usually the person can't re-fi on their own and it goes into foreclosureselling is the best option here but with this market, good luck.
