Divorced in 2005. Signed over the house into her name in July, 2005. I have rented since then, until this past year when I finally bought a new home. Jump to the present...Denied first time home buyers credit because mortgage interest was claimed in 06, 07, and 08. And not by me. The 1098's were even sent with my name on the envelope. She was remarried in 2006 and moved in to her new husbands house in 2007. And she claimed all the mortgage interest over those 3 years as a deduction. In 2007 and 2008, they were even sent to her husbands home and not the old house, still, with my name on them. She has rented our old home since January 2007 for $1100 until today (2010). So, my question. Do I just ask her to please work with me going through the hoops to satisfy the IRS, do I contact an attorney and claim one half of all rent for 2007 and 2008, or do I have a case.
