Default can the mortgage co. take my tax return if house was

forclosed on march 2008? after my divorce I could not pay for the house anymore and in march of 08 they took it, it was auctioned off. last yr after our taxes had already been filed we got a 1099-c I think it was in the mail to do with our taxes but like I said they were already done. I was told that if the mortgage co. forgave the loan that they could take our tax return, I called the mortgage co. and they said the loan had not been forgiven. I was wondering if when we do our taxes this yr (my new husband and I) can they just take it without telling us first....ok I was wrong I am sorry, it was the 1099-a that they sent me not the 1099-c. can they take my return?I also called the mortgage co today and they said that the loan has not been forgiven...
