Default Divorce and a Mortgage?

I have a friend who is getting a divorce and their home is going to her spouse. She is worried that if her soon to be ex-husband defaults on the loan it will affect her credit rating. Is there anything she can do to prevent this from happening? I doubt that the bank will re-fi the loans because they are upside down in their house. (The value of the loan exceeds the value of the house) In addition there is also a 2nd Mortgage on this home as well.

If he gets the house, her name will be off all the loans and she should not suffer any consequences in a default situation.

when she goes for the divorce she should ask the judge to get her name took off the loan to prevent him from destroying her creditand if not tell the court to make him sell the home and split the moneythe court should have no reason not to remove her from the loan for her protection.

Well , the first three answers are wrong......Quit claim the deed if they will let her..Call the bank a.s.a.p. Have it put in the divorce decree

This should not be a problem. You see, when he gets the house he will have to change the deed to put it in his name alone. Just tell her to make sure the judge requires him to change the deed to his name alone and quit claim the deed. (ubu is right, above)
