Charged off mortgage of deceased party?
A relative died and left me a house. I've lived in the house 3 years paying the mortgage, taxes, etc. I let the mortgage remain in the deceased party's name. I informed the lender and they continued to accept payments and send the mortgage note. The deceased party is the sole owner on the property deed. I never went to probate and got my name put on the deed (wan't sure if I wanted to keep the house). I have fallen behind in payments and recently learned the mortgage has been charged off and transferred to another company. My questions are: since the debtor is deceased and the mortgage has been charged off, will the bank begin to foreclose in the normal way (default notice, sheriff sale)? Does the home belong to the bank,since I haven't went to probate to add my name to the deed?
