Default I am closing on a home in about 2 weeks. What happens

if I split up with my wife? She is not on the mortgage? Should I still close on the house, or delay it until we decide what we will be doing?

Consult a lawyer before doing anything. Even though she is your wife it is best to cover yourself against the worst case scenarios.

If you are thinking about splitting up why buy a house? It does not matter if she is on the mortgage or not.

If you are going to split up with your wife, keep her name off not only the mortgage but the DEED especially. If her name is on the deed she can make you sell the house and split the proceeds.

Your lawyer would be the best place to start...divorce is a sticky subject and you wouldn't want to risk the chance of having guessed at the right decision...I would think that if she's not on the mortgage she wouldn't be entitled to any thing on the house but if you both are still legally married at signing...who knows the lawyer may tell you that it was purchased during your marriage therefore you split it....the law is hard to understand when it comes to divorce...When in doubt..don't...until you talk to your divorce attorney...good luck HH

You need to find out if your state is a community property state, becouse if it is than the house is half hers even if her name isn't on it.
