Default Does anyone know if a mortgage broker can

negotiate with your trustee instead of my lender to stop forclosure? I recently recieved a NOD with an auction date set at April 11,2008. I since then have tried to get a loan modification from my current lender and have had heard nothing in 3 months. I am sending cert letters to lender to ask to stop proceedings until i hear from them. I currently spoke with a mortgage broker who claims she can call the trustee and renegotiate my loan and keep current lender through the trustee and not have to go to my lender. Is this so or is something fishy going on?

Sounds to me that you are in foreclosure but have claimed bk? That is what you need to do.

Nothing is fishy your current lender doesn't want to deal with you as they have a auction date. They anticipate your home will be foreclosed. The trustee can negotiate as long as you are going into Bankruptcy (BK) and make your payments to the trustee on time or they can foreclose. Yes Mortgage Broker probably has the upper hand discussing this with them then you but always make a follow up call to confirm that they are all doing their jobs.

Default Negotiate with the Attorney

I think you are mistakenly calling the attorney the trustee. Unless it is a small bank negotiations are taken place in the loss mitigation departments and not with the foreclosing attorney. No, do not file bankruptcy unless you are down to the last days. We can help negotiate if you need assistance, we have been very good about getting to the lender fast. Let me know and because of the amount of files on the loss mitigators desk you have to become somewhat a bulldog.
