Default GMAC approved our loan modification then after 5 months said it is not approved

Hi,
I live in Phx Arizona, and have lived in my home for over 20 yrs.
recent hardships had caused us to go delinquent with our loan with GMAC.
We got a forbearance agreement to keep our home out of foreclosure.
We made monthly payments via Western Union all on time as GMAC was
doing a loan modification for us. long story short the modification was approved and
we were sent via fedex our modification, signed and notarized. This was NOT a trial
modification. We made 5 payments at the new rate all on time and they were accepted by
GMAC. GMAC has now contacted us and says that the modification took to long and is NOT
approved and says we need to resubmit all our financial statements ect. to get the mod
approved. When trying to contact GMAC we get xfered in a circle and then disconnected.
They will not let us speak with anyone from Loss Mitigation or the person that originally
approved our modification. They will not call us back as promised, and we are given
completely different information on an almost daily basis. At one point someone said
"oh yes I see where your mod has been approved" ..... He was going to call us back but never did.
Now nobody seems to be able to find thier copy of the Approved Modification.
I cannot get a phone number to the loss mitigation dept. so I have to start at collections.
I get the runaround and get xfered in a circle until they hang up.
This has been very stress full and I fear that GMAC will foreclose. Is the loan mod a legally
binding contract for GMAC as well as for me? After accepting 5 payments can they
just not approve the modification. I have the approved signed and notarized modification,
is it worthless? If anyone can answer my questions or tell me what rights I have or dont have
it would be much appreciated., as I cannot afford an attorney.. Thank You for reading

Dontarr, so I understand you are saying you had to get you loan modification notarized? If so they did that in order to record your loan modification with the county. What needs to happen is you request to speak to a supervisor. I know it I hear it all the time "they can not do anything I can not do..." that is a crock and you must demand and stay on hold until you get what you were approved for originally. I have not had any problems with GMAC although every once in a while we need to go in and fix issues for homeowners that were pushed around after they received a loan modification. Many times it is a system flw on the part of the mortgage company (servicer). I can go on but contact us and we may be able to help. 877-968-5337

Hope this helps as many as it has helped my family, We got denied a modification from gmac, so we contacted a company called HOPE in south florida, which is a non-profit organization that assisted us through the whole process untill our loan modification was complete, great company and service, they charge nothing to assist you, they were able to assist in lowering our mortgage balance , our monthly payment and our interest rate down to 4.2%, it took about 6 weeks to complete everything. I called 877-968-5337 and got great service hope all goes well with your situation as mine did. good luck
