I was just advised by the mortgage company that we are in foreclosure. Apparently effective Aug 5, 2010. I learned this when I called to make a payment this morning..and they refused to accept the payment.
History: We are past due for May, June, July and Aug.. previous to becoming 30 days late, for months we had been paying just before 30. I was laid off from my job of many years, with us out of my income we held on as long as we could.. As soon as we saw it coming we contacted the mtg company and asked for help.. They told us we did not qualify for the Obama Modification (as they called it).. so they allowed us to apply for a regular modification. -- After submitting the information by internet or phone 3 times.. I was told each time to call back and check the status. After each submission they would tell me it has been closed (within a week) because after I got off the phone telling them what was going on and that we really need this.. they would call while I was at work.. if I didn't answer that first time.. they would close it because they could not confirm with us that we needed the help... What kind of confirmation do they need??? we just got off the phone with them. Bottom line is we have begged them for help since before we were past due... they have only played games. They literally sent us a letter stating we were denied the Modification due to we were current on our mortgage and in no danger of default.. At that time we were more than 60 days past due....then literally 2 days later we received a letter from them stating we were in danger of Foreclosure.... My husband immediately called them and asked how could this be possible!??? They keep sending us letters offering to help us, but when I call they can't do anything for us.... Ugh!!! I have kept in touch with them, and have been working with one lady (and I do have their names) who I explained to her that my husband just took a job in Alaska to get enough money to catch up the mortgage... she told me they can work with me.. If I could have a payment my THIS week.. we can work out a payment arrangement...- I followed up last week by the deadline I was given and talked to a guy, I told him that I would be able to make a regular payment today and another the same time next week.. He told me this was acceptable I just had to understand I would still get collection calls. He NEVER mentioned foreclosure to me at all.. Also need to mention that this guy never noted anything more than I said I would make a pymt.. nevermind our 30 min convesation.. - and I told them to pull the phone call, they told me they don't record all calls so it prob didn't get recorded.. (How convenient)!! This brings us back to today.. They won't take my payment bc they say I'm in foreclosure.. When I asked why I have not received any legal documentation or any at all..They coud not explain.. I told them that 2 days ago I received a letter stating to call and they could help me..and the envelope is postmarked Aug 12, 2010, but the darn letter is dated June 30.. I"M SO TIRED OF THEM PLAYING GAMES.. I insisted on speaking with a supervisor who told me they have to have FULL payment due to forclosure.. so I went through the whole spiel again.. -- after much conversation she told me to call back this evening and give them the information to see if we qualify for a MODIFICATION again.. We just might.. I asked how could that be? Previously we did not qualify bc they told us our ratio between our outgoing and incoming did not qualify us, How would we qualify with my husband now making so much more money... She said it is worth a try.. -- She also THEN told me that we are in Foreclosure but she can't see where it has been assigned to an attorney yet.. So she is going to put it on HOLD until we see about the the modification.... This sounds to me like is not actually been submitted for FC yet...but I'm not sure.. It also sounds like they did not qaulify us for a MOD before because they didn't think we had enough money left over to keep up the payments after.. Is this why she is saying we may qualify now that we have more income again.. btw I'm also finally back to work.. Sorry for the long post but I'm so scared, I don't want to lose our home..
