I am a crime victim from October 2005 to the present, with Post Traumatic Stress Disorder as a result of the following:
> Cybercrime via Remote Desktop; > Loss of business, loss of income, the inability to remain self-employed; > Identity, bank, credit card, vehicular, weaponry and property theft; > Landline and cellular phone hijack/cloning; > Property damage; > Defamation of Character; > Invasion of privacy via GPS/GSM; > Breaking and Entering, Assault and Battery; > Failure to Protect and Serve The property in question is a small, one bedroom condominium located in Santa Fe, New Mexico. It is not my primary residency; currently, the condo is tenanted. I receive a rental income in the amount of 795 per month. I owned the condominium free and clear from 1988-2006. The original loan with Taylor, Bean & Whitaker was acquired to renovate my current residence. The debt was not in arrears when the loan passed to Bayview Loan Servicing. I estimate a financial deficit approximating 30-50K as a result of the aforementioned crimes. Numerous incidents are documented, police reports and civil suits filed, and dead-to-rights evidence is held by the D.A.'s office. Still, local authorities do nothing to alleviate my situation. My AAA-plus credit rating is destroyed and I have no liquidity other than income from the condo. I was self-employed as a Website Developer-Designer when the cybercrime took place. My computers are still compromised; thus, I am unable to work or find suitable employment in this depressed area that will afford adequate income to pay my mortgage debt and/or the condominium fee to the Homowners Association. The condo mortgage is a 4% ARM. Monthly payments were $340, yet recently increased to $370 due to the addition of PMI insurance, though I pay Homeowner's Insurance to the insurer and provided Bayview with a copy of the Declarations page as per their request at the onset. Bayview is looking into options; yet, because the interest rate is already low, the Investigator was not very encouraging and told me that Bayview was preparing to begin Foreclosure proceedings. The Santa Fe. New Mexico Real Estate market does not make it feasible to sell at this time The property constitutes my retirement. I don't want to lose it, Please direct me to an honest lawfirm that will help me to obtain Loan Modication. I would also appreciate your guidance regarding how I may address with the mortgage company and the Homeowner's Board of Directors in order to avoid Foreclosure. Thank you. Maggy-Pie |

Maggy,
I hear you and really do not understand your issue with cybercrime and everything else that is happening. The bottom line is that your property is an investment property and lenders/servicers do not take much pitty on speculations. There are a few mortgage companies that will work with investment properties but the best you can hope for is a 2% interest rate. The botom line is if you do not have enough income then there are not options but to short sale.
