My home is currently in foreclosure. There is both a mortgage and a HELOC. The bank has accepted payments on both -- even after the foreclosure was filled. Does that make the foreclosure void since they accepted payments? I can bring the accounts current, it's the attorney fees, etc. that are included right now.

You need to understand the difference between accepting payments and applying payments. The bank may accept payments but not apply to mortgage. The money can go into a suspense account where it will sit until the bank decides to send back. So because they accepted payments does not mean they are applying to past due amount.

CALL THE BANK ! Ask them where the payments are going, If you can get current, if you can work out an agreement. there is no person here (unless your banker is a forum member) that can answer those questions. |
