prepayment penalty question about mortgage...
...refi? Just refi'd my mortgage with a broker I've used a number of times in the past 3 years. My broker mentioned to me that I would have to stick with the loan for 6 months or penalty would be involved but didn't send me any details. When I did the closing, HUD statement, TIL etc specified that there was no prepay penalty on loan. 3-4 days after closing, my broker sends me an email stating that the title company forgot to have me sign a letter (early payoff penalty agreement). Broker told me that this was coming from the lender but I confirmed with the lender and the title company that there was no prepay penalty on this loan. The letter doesn't mention the lender (just the broker company).I suspect the broker didn't get this letter to the title company in time and wants me to sign it after the fact. I told the broker I would be open to signing it (i.e. keep my good relationship with them) but only if there is a no penalty for sale of house clause. Broker told me that lender wouldn't agree to it (don't know why they keep trying to tie the lender into this). I told the broker I already confirmed w/lender and title company that there was no prepayment penalty as far as they were concerned. Broker states that I don't have to sign the agreement but they would get penalty from lender if I payoff loan within 6 months (whether it's a refi or sale or property).What is the motivation for my broker to have me sign this agreement?
