Default if tenants have 30 days to move out because

owner didn't pay the mortgage, can they sue? We have been renting a house at $600 a month and we recently received a notice that we have 30 days to move out. What we have gathered is that the owner hasn't been paying the mortgage and the house is foreclosing.Is it possible that if taken to small claims court that the judge will rule in our favor? t(we would be suing for the months that were not paid at $600 a month)

You rented the house from the owner but him not paying his mortgage has no bearing on it.The bank is foreclosing on him because of this and you are probably being forced to move as the bank will try to sell the house to collect on what he owes.You should instead look into finding out from the bank if you can continue living there as long as you pay the bank the rent and even see about assuming the mortgage and wind up owning the house yourself.
