Default Do I have to pay if my ex husband received the

first time home buyers credit and I'm not on the mortgage? He qualified for the tax credit in 2008 when we were married but he and his father are on the mortgage. My ex and I filed for a divorce the following year and still filled our taxes jointly for 2009. After the divorce became finalized I received a letter from the IRS telling me I needed to pay back the $3750.00 but my ex did not receive anything. He still lives in the house, and I was told that because he is still living in the house after the divorce that he would be responsible for paying that back. Also, we never received an actual check from the treasury, his father's CPA did our taxes and we were cut a check from my ex's father-in-law's account made payable to my ex if that makes a difference. Any help would be great since I'm getting my taxes done next week and I'm extremely nervous about the outcome. Thanks in advance!My name is not on any part of the house documentation, I think his father made sure of that incase we ever got a divorce
