I made the down payment and seller refuses
me a mortgage? In 2005 I sold a house to a woman in Calaifornia who wanted to move to Maine. Then 2 years later in 2007 she emailed me and told me that she changed her mind and wouldn't be moving and asked me if I'd like to buy the house back. I told her yes. I asked her for owner financing, she agreed. She asked for a $2,000.00 down payment on the house which I agreed and sent her the down payment the same day that I received the email from her. She also agreed to pay to have her attorney draw up the paperwork, sign it and send it to me asap. She emailed me to tell me that she received the down payment money and said that she was going to contact her attorney the next day. She never contacted the attorney and I'm still waiting for the owner financing mortgage from her (and this is 4 years later). NOTE: In 2009 I also sent her another $170.00 upon a promise (again) that she was going to have her attorney draw up the paperwork asap. Again I never got any mortgage or paperwork from her OR her attorney. I have no mortgage from this woman at all. I feel that she frauded me and just took my money and ran. I know the property is real and so is this woman. All I want is a mortgage and she refuses to send me one, what is my remedy for this? Legal or criminal?I contacted the local state police as well as the police dept in California (where she lives) and both depts say they won't do anything to help me. I feel this is fraud and I have all my receipts of the money that I sent to her as well as the emails she sent me.The reason why I waited so long is because even without sending me the paperwork, she assured me that the house and property was mine. I did start remodeling shortly after I sent the down payment to her, including new vanity, new linen closets, new locks on the door and more. I did stop remodeling after a while though. And no, I don't live there. The statute of limitations is 6 years in this state.
