Default If my husband's name is on our property taxes,

but not mine. And if my name is the only one on the mortgage,? who owns the home,

It depends on your state law. If you legally married and live in a community property state, you both own the home regardless of who is on the mortgage. The person whose name is not on the deed make take some legal action to 'advertise' their interest in the court records.
