Default If a mother will not pay the mortgage on time

should she lose custody of her kids ? My ex. wife has custody of my 2 sons, and they live in the house she was granted during the divorce, but she refuses to pay the house payments on time to the point that she may lose the house. If she loses the house, should she also lose full custody of the kids. I do pay child support and i also give my sons a allowance 2 twice a month, so that she don't have to try to keep change in their pockets

Not necessarily. Maybe she cant afford the house. But if she ends up homeless and you have a stable home environment for the kids, why dont you just file for full custody?

If she can afford the mortgage and it's just bad budgeting or laziness then maybe she shouldn't or even doesn't want full custody. As said above if you are in a position to offer them a home then apply for joint or full custody

it depends if she isnt paying it on purpose then yeah maybe they should live with you but if she cant afford it then it isnt nesercerilly her fault sso it all depend on the cercumstances

Of course not...being bad with money does not make you a bad Mother! If that were the case then thousands ./..even millions of parents would lose their children!

The job of the parent is supply a stable home environment. But as we know crap happens. If she is being cut hours at work and is getting behind on her bills like so many people are right now then that doesn't make her a bad parent. But if she is going out spending money on other things than what is needed, trying to live the high life on a McDonald's income, then you should apply for full custody. With all questions concerning custody, you should contact your lawyer. They will know the laws in your area better and whether it is worth at this time challenging the courts previous ruling.

I don't see why. I think she'd just lose the house if she didn't pay her mortgage! Never heard of kids being taken away for failure to pay mortgage. Unless that's part of your court agreement, but you don't mention that and I doubt it would be allowed.

Looks like you are taking the high road. Let the courts decide, but usually they will keep her in housing as long as she has dependants .
