Default do I have legal recourse on mortgage broker getting .25%

on back end? I was informed my "locked rate was 6%"- though settlement papers signed 8/13/2008 lists APR 5.75% and lists rate as 6%- though paid 1% mortgage broker fee along with other lender fees totalling over 3G on 130 G mortgage and YSP listed $166 POC....I know I was taken advantage of but do I have a legal case or request modification of loan from broker...
