and 2nd Mortgage both with Countrywide? I hold a mortgage on a home in Washington State and I am no longer able to afford my payments. I can not afford to sell the house as the loan to value is upside down. The 1st and 2nd mortgage are both with Countrywide mortgage. What am I up against? Does the lender have the right to sue on the note in Washington State? Can they legally take away my non-exempt assets? Has anyone had experience dealing with a foreclosure in Washington State. Any information on dealing with Countrywide mortgage would be particularly helpful. Thanks in advance!

Thee are state laws that you can review. But you need to have a loss mitigation expert do a free profile on your situation. Many times depending on what is negotiated, be it a loan modification or a short sale we may be able to get the lender to waive the deficiency on the property in lieu of a shortsale.
